Do all Personal Data Breaches need to be reported?

Under the GDPR, the destruction, loss, alteration, unauthorised disclosure of, or unauthorised access to Personal Data must be reported to a Supervisory Authority within 72 hours.

Must be reported in 72 hours, unless…

A Supervisory Authority doesn’t need to be notified if:

  • the Data Controller has “implemented appropriate technical and organisational protection measures” that “render the data unintelligible to any person who is not authorised to access it, such as encryption”
  • the Data Controller takes actions subsequent to the Personal Data Breach to “ensure that the high risk for the rights and freedoms of data subjects” is unlikely to materialise, or
  • when notification of each Data Subject would “involve disproportionate effort”. In which case, alternative communication measures may be used.
