Does the GDPR think my organisation has any employees in the EEA?

It’s not always obvious whether an organisation does, or doesn’t, have employees in the EU.

Your organisation might not employ any EU citizens as such, but if one of your employees currently resides in the EU, then your company needs to be compliant with the GDPR, even though that employee is a citizen of a country outside the EEA.


An organisation in the USA might not employ EU citizens to their knowledge. But say they have an employee who is born in the USA, lives in the USA and works mainly in the USA. If that person visits the EU and, irrespective of the amount of time they are there, does anything involving a Data Subject (irrespective of where the data subject is from) then that US-based organisation needs to be compliant with GDPR.
