What are the penalties for non-compliance with the GDPR?

Organisations can be fined up to €20 million or 4% of annual global turnover, which ever is the greater, for breaching the GDPR regulation. This is the maximum fine for the most serious infringements such as, insufficient customer consent to Process Personal Data or contravening the core Privacy by Design concepts.

An organisation can also be fined up to €10 million or 2% of annual global turnover for not having their records in order (Article 28), not informing the Supervising Authority and Data Subject about a Breach, or not conducting a Data Protection Impact Assessment (DPIA).

These rules apply to Data Controllers and Data Processors who can both be held liable.
