What happens if my organisation is not in compliance with GDPR?

For a serious breach of the GDPR, such as a major security breach where the organisation has woefully inadequate protective measures in place, the maximum administrative fine is up €20 million or 4% of global turnover, whichever is higher.

For other breaches, such as inadequate record keeping, or failure to report a breach, regulators will have the power to issue penalties of up to €10 million or 2% of global turnover.

Under Article 82 of the Regulation, there’s a direct right of action for Data Subjects to claim unlimited compensation from the Data Controller or Data Processor if Personal Data has been incorrectly held, or used, and the Data Subject has suffered damage.
